Secondary grade teachers’ pay degraded?
In continuation to my e-mail dated 20.01.2011 the following additional information is also furnished for remedial action. The degrading of pay w.e.f 1.6.2009 is due to the advertently or inadvertently made omission of the Entry pay in the revised pay structure for direct recruits appointed on or after 1.1.2006 as laid down in Section-II of Part A of First Schedule to the CCS (RP) Rules,2008.(vide page 43). Relevant rules of both CCS & TN pay are furnished below for comparison.
Rule 8 of the CCS Revised Pay Rules,2008 is furnished below:(vide page 39)
8. Fixation of pay in the revised pay structure of employees appointed as fresh recruits on or after 1.1.2006.
Section II of Part A of the First Schedule of these Rules indicates the entry pay in the pay band at which the pay of direct recruits to a particular post carrying a specific grade pay will be fixed on or after 1.1.2006. This will also be applied in the case of those recruited between 1.1.2006 and the date of issue of this Notification.

Rule 9 of Tamil Nadu Revised scale of pay Rules, 2009 is furnished below:(page 16) 9. Fixation of Pay of Employees appointed on or after 1.1.2006. Fixation of pay in the revised pay structure of employees appointed as fresh recruits on or after 1.1.2006, the entry level pay in the pay band at which the pay of direct recruits to a particular post carrying a specific grade pay shall be fixed on or after 1.1.2006. This procedure is also applicable in the case of those recruited between 1.1.2006 and the date of issue of this Notification/Orders.
Hence, there is an anomaly in the fixation of pay of employees appointed on or after1.1.2006 for TN state employees.
Pay is fixed at Rs.11,360 for grade pay 2800 to Central employees w.e.f 1.1.2006 (appointed on or after 1.1.2006).
In Tamil Nadu, for grade pay 2800, pay is fixed at Rs.11,170 referring the table No.10 in page 37 for those who appointed on or after 1.1.2006 but before 1.6.2009 and fixed at Rs.8,000 referring the pay structure of GP 2800 for those who appointed on or after 1.6.2009.(Entry level pay in the pay band is Rs.8560+2800=Rs.11,360. This is omitted in the Rule 9).
There is no provision in the rule to fix differently for appointed on or after 1.1.2006 and 1.6.2009. The fixation table No.10 in page 37 is only for those who appointed before 1.1.2006. Hence the fixations at Rs.11,170 & Rs.8000 are wrong in the absence of the Section II table as laid down in rule 8 of CCS RP Rules 2008 regarding entry pay in the pay band.
The remedy is either to approach the Govt to get inserted the omitted Section-II Table of Rule 8 of the CCS RP Rules 2008 into the Rule 9 of TN Revised scale of pay Rules 2009 OR to approach the Court, as the Govt has already announced that the State employees were given Central pay parity. If you go to Court, you will sure to win.
This anomaly is not only to teachers but also to all the employees. The worst affected are the Secondary grade teachers of GP 2800.
